These General Terms and Conditions of Sale govern the offer, forwarding, and acceptance of purchase orders for products on Anima Costiera and do not govern the provision of services or the sale of products by parties other than the seller that may be present on the same site through links, banners, or other hypertext connections.
Before placing orders and purchasing products and services from third parties, we suggest checking their sales conditions.
3 Conclusion of the Contract
To conclude the purchase contract, it will be necessary to fill in the “order form” in electronic format and submit it following the relevant instructions.
It contains a reference to the General Terms and Conditions of Sale, the images of each product and the related price, the payment methods available, the delivery methods of the purchased products and the related shipping and delivery costs, a reference to the conditions for exercising the right of withdrawal, and the methods and timing for returning purchased products.
Before concluding the contract, you will be asked to confirm that you have read the General Terms and Conditions of Sale, including the information on the right of withdrawal and the processing of personal data.
The contract is concluded when the seller receives the “order form,” after verifying the correctness of the data contained therein.
The purchaser will be obliged to pay the price from the moment the online order submission procedure is completed. This will occur by clicking on the “Complete Order” button at the end of the guided procedure.
Once the contract is concluded, the seller will process the order for fulfillment.
4 Registered Users
When completing the registration procedures, the user undertakes to follow the instructions on the site and to provide their personal data accurately and truthfully.
Confirmation will in any case exempt Anima Costiera from any responsibility regarding the data provided by the user. The user undertakes to promptly inform Anima Costiera of any changes to their data at any time.
If the user provides inaccurate or incomplete data or if there is a dispute by the interested parties regarding payments made, Anima Costiera will have the right not to activate or to suspend the service until the relevant shortcomings have been remedied.
Upon the first request to activate a profile, Anima Costiera will assign the user a username and password. The user acknowledges that these identifiers constitute the validation system for the user's access to the Services and the only system suitable for identifying the user, and that acts performed through such access will be attributed to them and will be binding on them.
The user agrees to maintain the confidentiality of their access data, to keep them with due care and diligence, and not to transfer them, even temporarily, to third parties.
5 Product Availability
Product availability refers to the actual availability at the time the purchaser places the order. Such availability must, however, be considered purely indicative because, due to the simultaneous presence of multiple users on the site, products could be sold to other customers before the order is confirmed.
Even after the order confirmation email is sent, cases of partial or total unavailability of goods may occur. In such cases, the order will be automatically adjusted by removing the unavailable product, and the purchaser will be immediately informed by email.
If the purchaser requests cancellation of the order, thereby terminating the contract, Anima Costiera will refund the amount paid within 60 days from the moment it became aware of the purchaser’s decision to terminate the contract.

7 Payment Methods and Prices
The price of the products will be as indicated from time to time on the site, except where there is an obvious error.
In the event of an error, Anima Costiera will notify the purchaser as soon as possible, allowing them to confirm the order at the correct amount or to cancel it. In any case, Anima Costiera will not be obliged to supply the item sold at the lower price incorrectly indicated.
The prices on the site include VAT but do not include shipping costs. Prices may change at any time. Such changes will not apply to orders for which an order confirmation has already been sent.
Once the desired products are selected, they will be added to the cart. Simply follow the instructions for purchase, entering or verifying the required information at each step of the process. Order details may be changed before payment.
Payment can be made by credit card.
8 Delivery
Anima Costiera ships worldwide.
Delivery takes place as specified in the “order form” by the date indicated therein; if no delivery date is specified, within the estimated period indicated when selecting the delivery method and, in any case, within a maximum of 60 days from the date of confirmation.
If delivery is not possible, the order will be sent to the warehouse. In such a case, a notice will specify the location of the order and the methods for arranging a new delivery.
If you are unable to be present at the delivery location at the agreed time, please contact customer service to arrange a new delivery date.
If delivery cannot take place for reasons not attributable to us within 10 days from the date the order is available for delivery, we will assume that you intend to terminate the contract.
As a result of termination, amounts paid will be refunded, including delivery costs, except for any additional costs resulting from choosing a different delivery method than the standard one offered, without undue delay and in any case within 60 days from the date of termination of the contract. The transport resulting from the termination of the contract may incur additional costs, which will be borne by the purchaser.
Shipping costs are borne by the purchaser and are explicitly indicated at the time of order placement.
9 Transfer of Risk
The risks relating to the products shall pass to the purchaser from the time of delivery. Ownership of the products shall be acquired upon full payment of all amounts due in relation to them, including shipping costs, or upon delivery if this occurs later.
10 Warranty and Commercial Compliance
The seller is liable for any defect in the products offered on the site, including non-conformity of the items to the products ordered, in accordance with Italian law.
If the purchaser has entered into the contract as a consumer, i.e., any natural person acting on the site for purposes unrelated to their business or professional activity, this warranty is valid provided that the defect appears within 24 months from the date of delivery of the products; that the purchaser makes a formal complaint regarding the defects within a maximum of 2 months from the date the defect was recognized; and that the online return form is correctly completed.
In the event of non-compliance, the purchaser who entered into the contract as a consumer shall be entitled to have the products brought into conformity free of charge, by repair or replacement, or to obtain an appropriate price reduction or termination of the contract for the disputed goods and the consequent refund of the price.
All return costs for defective products will be borne by the seller.
11 Withdrawal
In accordance with the legal provisions in force, the purchaser has the right to withdraw from the purchase without penalty and without specifying the reason, within 14 days pursuant to Art. 57 of Legislative Decree 206/2005 from the date of receipt of the products.
In the case of multiple purchases made by the purchaser with a single order and delivered separately, the 14-day period begins from the date of receipt of the last product.
The purchaser who intends to exercise the right of withdrawal must communicate it to Anima Costiera through an explicit declaration, which may be sent by registered letter with acknowledgment of receipt or by accessing the section: www.anima-costiera.com/contatti-anima-costiera.php on the Anima Costiera website to create a request.
The purchaser may also exercise the right of withdrawal by sending an explicit declaration containing the decision to withdraw from the contract or alternatively by sending the standard withdrawal form referred to in Annex I, Part B, Legislative Decree 21/2014, which is not mandatory.

The goods must be returned intact, in their original packaging, complete in all their parts, and with the attached tax documentation. Without prejudice to the right to verify compliance with the above, the site will refund the amount of the products subject to withdrawal within a maximum period of 60 days, including any shipping costs.
As provided by Art. 56 paragraph 3 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the site may withhold the refund until the goods are received or until the purchaser demonstrates that they have returned the goods.
The site will carry out the refund using the same payment method chosen by the purchaser during the purchase phase. In the case of payment made by bank transfer, and if the purchaser intends to exercise their right of withdrawal, they must provide the bank details: IBAN, SWIFT, and BIC necessary for the refund.
The refund of any returns is only for the products and in no case for shipping.
12 Data Processing
The purchaser's data is processed in accordance with the provisions of the legislation on personal data protection, as specified in the specific section containing the information pursuant to Art. 13 of Legislative Decree 30 June 2003 (Privacy Policy).
13 Safeguard Clause
If any of the clauses of these General Terms and Conditions of Sale is null for any reason, this will not in any case compromise the validity and compliance with the other provisions set forth in these General Terms and Conditions of Sale.

15 Applicable Law and Jurisdiction
These General Terms and Conditions of Sale are governed by and interpreted in accordance with Italian law, without prejudice to any prevailing mandatory provision of the country of habitual residence of the purchaser. Consequently, the interpretation, execution, and termination of the General Terms and Conditions of Sale are subject exclusively to Italian law, and any disputes relating to and/or arising from them shall be resolved exclusively by the Italian judicial authority. In particular, if the purchaser qualifies as a Consumer, any disputes shall be resolved by the court of the place of domicile or residence of the same according to the applicable law.
